Overview

A Settlement Agreement has been reached in two class action lawsuits alleging that Coinstar, LLC (“Coinstar”) violated federal law and California state law by operating Coinstar-branded automated kiosks that were not accessible to Legally Blind individuals. Those lawsuits are Nguyen v. Outerwall Inc., No. 5:16-cv-00611-LS (E.D. Pa.) and Boyer v. Outerwall Inc., No. 2:17-cv-00853 (E.D. Pa.). Those two lawsuits were consolidated for purposes of this Settlement.

The Settlement Class consists of all Legally Blind individuals who attempted, but were unable to access or who were deterred from accessing those products or services available at Coinstar Kiosks in all 50 states and the District of Columbia during the time period starting February 8, 2014 for all states and the District of Columbia and continuing through July 14, 2017. For purposes of this settlement, Coinstar Kiosks are defined as a Coinstar-branded automated kiosk that permits individuals to exchange their coins for cash or a value product and is located at a retail store within the United States.

The California Sub-Class consists of all Legally Blind individuals who attempted, but were unable to access or who were deterred from accessing those products or services available at Coinstar Kiosks in California during the time period starting on February 8, 2013 and continuing through July 14, 2017.

If you are a member of the Settlement Class, you are entitled to the non-monetary equitable relief which is summarized in Section II of the Long Notice.

If you are a California Sub-Class Member you may qualify for a portion of the $500,000.00 Settlement Fund as summarized in Section III of the Long Notice.

As a member of either the Settlement Class or the California Sub-Class, your legal rights are affected whether you act or do not act.

(For Non-California Sub-Class Members)
For the non-monetary equitable relief, you do not need to do anything in response to this Long Notice. If the Settlement is approved by the Court and you are a member of the Settlement Class, you need not take any action in order for the equitable relief to be implemented.
FILE A COMMENT OR AN OBJECTION Deadline: December 1, 2017 If you want to submit comments about or objections to any aspect of the Settlement, you may submit your comments or objections in writing to the Court and the parties’ attorneys by December 1, 2017, in accordance with the instructions set forth in Section VI of the Long Notice.
GO TO A HEARING Scheduled: December 20, 2017 If you submit comments or objections to the Settlement to the Court, you and/or your attorney may appear at the Fairness Hearing. The Hearing is scheduled to take place at 10:00 a.m. on December 20, 2017, at the U.S. District Court for the Eastern District of Pennsylvania, in Courtroom 14B of the James A. Byrne United States Courthouse, 601 Market Street, Philadelphia, Pennsylvania.

(For Equitable Relief)
For the non-monetary equitable relief, you do not need to do anything in response to this Long Notice. If the Settlement is approved by the Court and you are a member of the California Sub-Class, you do not have to do anything in order for the equitable relief to be implemented.

(For Monetary Relief)
If you want to receive your portion of the California Settlement Fund, you must submit a claim form by December 1, 2017, in accordance with the instructions set forth in Section VII of the Long Notice.
OPT OUT OF DAMAGES PORTION OF SETTLEMENT Deadline: December 1, 2017 If you want to opt out of the damages (money) portion of the Settlement, you must submit an opt-out request to the claims administrator in accordance with the instructions set forth in Section VIII of the Long Notice by December 1, 2017.
FILE A COMMENT OR AN OBJECTION Deadline: December 1, 2017 If you want to submit comments about or objections to any aspect of the Settlement, you may submit your comments or objections in writing to the Court and the parties’ attorneys by December 1, 2017, in accordance with the instructions set forth in Section VI of the Long Notice.
